Attorney General William P. Barr issued guidelines yesterday laying out

steps to implement Trump White House proposals banning most immigrants from entering the U.S. until federal court systems can handle those cases fully and efficiently. A letter sent by DOJ Press Secretary Steven Goldstein said DOJ can accept the White House proposals without further "detailed legislative language, much to ensure they remain a lawful, appropriate process that benefits the immigrants and American community." Goldstein said, 'this final order of instruction is an implementation of our legal responsibilities as well as is consistent with federal criminal and immigration laws including DOJ's longstanding policy for cases where detainees have previously raised due process and statutory or treaty issues. 'This final order directs a transition within Immigration, Border and Transit (IBNT), from previous policies of expedited case transfers that operated in an ad hoc fashion that was unable fully to adjudicate the immigration matters pending before each detainee, prior to a scheduled court appearance. This guidance instructs our Border Protection & Detention professionals who may hold detainee removals cases within or between judicial systems with a pending legal proceeding (where this policy of transfers may not be consistent with the current law of our jurisdiction); instead, we recommend transferring all such detainee cases to the district attorneys with offices outside the federal district court of that state. DOJ now has a complete guidance on detaining cases with detainees. 'Additionally, as is often required with a final decision regarding this order, which addresses all immigration laws on point such as DACA and the RA/R-1 visa restrictions the Trump administrator is attempting to change to help protect the legal presence of DACA recipients and those with the valid noncitizen greencard which enables the United States to collect the DACA fee and not charge visa or Green Card status fees.
